R (on the application of Pharmaceutical Services Negotiating Committee and another) v Secretary of State for Health; R (on the application of National Pharmacy Association) v Secretary of State for Health

Pharmacy – Remuneration. The Administrative Court dismissed the claimants' challenge to the defendant Secretary of State's decision concerning reduction of the remuneration of pharmacies within the NHS as part of the financial savings required. The consultation process had not been unfair due to a failure to disclose information about what had been done to try and assess the likely number of closures, as it would not have made any difference, and proper regard had been had to the duty to reduce inequalities and the public sector equality duty.
