Since it was not established on the balance of probabilities that the claimant was the OM named in a valid birth certificate, he had not established that he was a British citizen and, therefore, was not entitled to a declaration to that effect. Accordingly, the Administrative Court held that the defendant Secretary of State's decision to refuse the claimant a UK passport had been lawful.
