Local authority – Child. The defendant local authority had breached its duty, under s 20 of the Children Act 1989, to recognise the claimant as a child in need requiring accommodation. The Administrative Court, in allowing the claimant's application for judicial review, further held that, as the claimant had been a looked after child in excess of the prescribed 13 week period, the authority was under a duty to provide assistance as required in accordance with s 23C of the Act.
