R (on the application of K and others) v Secretary of State for Defence and another

Human rights – Right to fair trial. In the course of the claimant Afghani nationals' judicial review proceedings arising from their alleged work for the defendant Secretaries of State in Afghanistan as covert human intelligence sources, the Divisional Court held that disclosure to the extent already ordered would not require it to act inconsistently with art 6 of the European Convention on Human Rights. The claims relied on by the claimants had not engaged art 6 of the Convention.
