R (on the application of Christchurch Borough Council) v Secretary of State for Housing Communities and Local Government

Local authority – Restructuring of local government. The Secretary of State had had power under the Cities and Local Government Devolution Act 2016 to make the Dorset (Structural Changes) (Modification of the Local Government and Public Involvement in Health Act 2007) Regulations 2018, SI 2018/636, reorganising local government in Dorset, including abolishing the claimant local authority, and there was no vice of retrospectivity. The Administrative Court further held there was no compelling reason for reading down the words of the s 15(3) of the Act and treating reg 4 as ultra vires.
