Immigration – Leave to remain. The Administrative Court allowed the claimant Zimbabwean national's application for judicial review of the defendant Secretary of State's failure to serve notice of a decision on his application to vary his leave to remain and to detain him. The failure to serve the decision meant that his leave to remain continued, by the operation of s 3C of the Immigration Act 1971, up to and beyond a period of detention to which he was subject and he would be awarded £10,500 for the unlawful detention.
