Broadcasting – Government control over broadcasting. Fox had confirmed that it would not bring an application for review in respect of the Secretary of State's decision that its proposed acquisition of Sky's shares might be expected to operate against the public interest, taking into account the media plurality public interest consideration. Accordingly, the Administrative Court held that the claimant's application for review of Ofcom's decision, that allegations of impropriety against Fox News did not provide a sufficient basis to decide, in advance of a proposed merger between Fox and Sky, that Sky would not remain fit and proper to hold its licences, was academic.
