Accordingly, the Administrative Court held that the claimant's application for review of Ofcom's decision, that allegations of impropriety against Fox News did not provide a sufficient basis to decide, in advance of a proposed merger between Fox and Sky, that Sky would not remain fit and proper to hold its licences, was academic.
