Criminal law – Trial. Pursuant to the Criminal Justice Act 2003 s 61(1), a judge's ruling in granting a stay of the applicant's private criminal prosecution of the two respondents would be reversed. The Court of Appeal, Criminal Division held, amongst other things, that the judge had placed too much weight on insignificant matters and failed to give sufficient weight on other matters that ought to have been in consideration when considering the respondents' application for a stay. The ruling had been one which it had not been reasonable for the judge to have made in the circumstances.
