Bankruptcy – Sequestration – Deceased person's estate. Sheriff Court: In proceedings in which the executor of a deceased person sought to have the deceased's estate sequestrated the court held that the executor did not have an absolute and unfettered right to seek sequestration of the deceased's estate for any reason: as a general rule a deceased's estate had to be insolvent before the executor could apply for sequestration.
