Ogunkoya v Harding

Copyright – Infringement. The Intellectual Property Enterprise Court dismissed the claimant's proceedings against the defendant, alleging that, in writing his book, he had made unlawful use of chapters of her book. If the claim was for copyright infringement, there was no evidence that the defendant had made use of material derived directly or indirectly from the claimant's work and, if the claim was for breach of confidence, no express of equitable duty of confidence had been imposed.
