Design – Registered design. Article 8(2) of Regulation (EC) 864/2007 of the European Parliament and Council meant that, where the same defendant was accused of various acts of infringement in various member states, the correct approach for identifying the event giving rise to the damage was, not to refer to each alleged act of infringement, but to make an overall assessment of that defendant's conduct to determine the place where the initial act of infringement had been committed or threatened. The Court of Justice of the European Union further ruled on jurisdiction in respect of a co-defendant domiciled outside the member state of the forum and the territorial scope of the jurisdiction of the European Community design courts.
