The defendant Metropolitan Police Commissioner had not breached of the operational, general or framework duties, under art 2 of the European Convention on Human Rights, as there had been no unjustified use of force by police officers in restraining the deceased and the compliant system of training had been implemented. The Queen's Bench Division further held that it followed from the findings that there had been no breach of the deceased's rights under art 3.
