Immigration – Deportation. The applicant Nigerian national's deportation from the United Kingdom would not be in breach of art 8 of the European Convention on Human Rights, despite the length of his residence in the UK, his ongoing relationship with his son and other family members, and his limited ties with his home country. The European Court of Human Rights held that, regardless of whether or not paras 398 and 399 of the Immigration Rules could be said to impose a higher standard than that of proportionality, all the domestic decision-makers had considered the proportionality test required by art 8.
