McMillan v Procurator Fiscal, Paisley

Criminal procedure – Criminal courts – Initiating warrant – Suspension – Jurisdiction. Sheriff Appeal Court: Declining to hear parties on a bill of suspension in which the complainer sought suspension of an initiating warrant granted by a sheriff in chambers, the court concluded that suspension of such a warrant granted by a sheriff exercising his administrative powers remained subject to the jurisdiction of the High Court of Justiciary and the bill was incompetent in the Sheriff Appeal Court, which had no jurisdiction to consider it.
