The district judge had erred in the exercise of his discretion that there should be a limit on the claimant's recovery of costs as a result of the second defendant's concession of liability to a claim that was independent of that alleged against all three defendants. The Queen's Bench Division, in allowing the appeal, held that a number of factors had indicated that the two claims were sufficiently linked to make a Bullock order appropriate.
