European Union – Trade marks. The Fourth Board of Appeal of the European Union Intellectual Property Office had correctly upheld the opposition filed by the intervener, Lion Capital LLP (established in London), against the registration by the applicant, Lion's Head Global Partners (also established in London), of the word mark 'Lion's Head'. The Board had held that, pursuant to art 8(1)(b) of Council Regulation (EC) 209/2007, there was a likelihood of confusion between that mark and an earlier EU word mark 'LION CAPITAL' . Accordingly, the General Court of the European Union dismissed the applicant's action for annulment of the Board's decision.
