KR v Stirling Council

Parent and child – Adoption. Court of Session: Refusing an appeal by the mother of a child against a sheriff's decision to grant a local authority's application for a permanence order with authority to adopt, the court held that the challenge to the sheriff's making of a permanence order must fail notwithstanding the incorrect approach he adopted to the threshold test under s 84 of the Adoption and Children (Scotland) Act 2007, and that the sheriff was justified in dispensing with the mother's consent to the placing of the child for adoption.
