Employment – Unfair dismissal. The Employment Appeal Tribunal (the EAT) dismissed the employee's appeal against the decision of the employment tribunal (the tribunal), at a remitted hearing, to reduce, by 75%, both the basic and compensation awards granted to the employee, following a finding of unfair dismissal, due to the employee's conduct. The EAT held that the tribunal had correctly distinguished the tests required by ss 122(2) and 123(6) Employment Rights Act 1996, and it had been entitled to find that the employee had behaved in a blameworthy or culpable way prior to her dismissal, such that it had been just and equitable to make a reduction.
