Limitation of actions – Prescription – Relevancy of averments of loss. Court of Session: Allowing reclaiming motions and refusing cross-appeals in two actions in which the liquidator of a company sued two firms of solicitors for damages for loss caused by the facilitation of fraud, the court concluded that issues relating to prescription focused in the pleadings could not be resolved without proof, and it rejected an argument that there were insufficient relevant averments of loss suffered by the company to go to proof.
