Noise – Safety of employee. The defendant Royal Opera House Covent Garden Foundation had breached regs 5, 6, 7 and 10 of the Control of Noise at Work Regulations 2005, SI 2005/1643, causing the claimant professional viola player acoustic shock. The Queen's Bench Division held that the claimant had not been contributorily negligent as, although he should have left the rehearsal earlier, it could not be found that, had he done so, it would have prevented the injury which he had sustained.
