The claimant companies successfully applied for permission to adduce survey evidence in passing-off proceedings concerning a product used for the treatment of asthma and chronic obstructive pulmonary disease. The Chancery Division held that, among other things, although the survey evidence was costly, it was not so in a quantity which would be a disproportionate share of the overall resources to be devoted to what was a high value commercial dispute.
