Environment – Protection. The prescribed fee for permits to install any form of polluting apparatus in Trinidad and Tobago was in breach of the statutory natural environmental policy. The Privy Council held that the regulations imposing the fee were not consistent with the 'polluter pays' principle, as enshrined in Trinidad and Tobago's national environmental policy.
