Solicitors – Duty – Conflict of interest – Protection of confidentiality. Court of Session: In an action for reduction of a policy of insurance on the ground of non-disclosure in which the defender sought the withdrawal of the pursuers' new firm of solicitors, BLM, from acting, failing which interdict against them on ground of conflict of interest, a Mr Moore, now a consultant of BLM, having briefly acted for the defender at an earlier stage and his former firm having subsequently become part of BLM, the court refused the defender's motion, holding that confidentialty was the dominant consideration and it was clear that there was no risk of misuse of information the defender had imparted in confidence to Mr Moore.
