It had been open to the respondent magistrates' court to find that there had been a group of men committing an affray and the justices had not been required to attribute a particular role to the appellant once they had been satisfied that he had been acting as part of that group, all of whom had been using unlawful violence. Accordingly, the Divisional Court dismissed the appellant's appeal by way of case stated against his conviction for affray.
