Personal injury – Post traumatic stress disorder (PTSD) – Breach of statutory duty – Liability. Court of Session: Refusing a reclaiming motion and cross-appeal in an action by a pursuer who sued his former employers for chronic PTSD said to have been suffered as result of a fire at a power station when he had to be rescued from the roof of a tall building, the court concluded that the Lord Ordinary had not erred in holding that the pursuer had failed to prove breach of the obligations imposed by s 53 of the Fire (Scotland) Act 2005 or reg 40 of the Construction (Design and Management) Regulations 2007.
