Extradition – Private and family life. In assessing proportionality under art 8 of the European Convention on Human Rights, the judge had clearly been wrong and the balance fell in favour of extradition. Accordingly, the Divisional Court allowed the appellant judicial authority's appeal against the judge's decision to discharge the respondent from extradition to Poland to serve sentences of imprisonment for joint enterprise assault, mental and physical harassment, threatening to cause his partner permanent disability, and kicking and hitting his partner's dog committed between March 2001 and January 2008.
