The Second Board of Appeal of the European Union Intellectual property Office had erred in its assessment of the descriptive character of the sign at issue 'Devin' by concluding that the mark was descriptive of a geographical origin as regards the average consumer in the neighbouring countries of Bulgaria, namely Greece and Romania, and in all the other member states of the EU, with the sole exception of Bulgaria. Accordingly, the General Court of the European Union annulled the Board's decision.
