Immigration – Appeal. The Court of Appeal, Civil Division, held that the Upper Tribunal (Immigration and Asylum Chamber) had been correct in its assessment that the First-tier Tribunal (Immigration and Asylum Chamber) had applied the wrong legal test when allowing the appeal against the decision of the respondent Secretary of State to deport the appellant to Jamaica following his conviction for a criminal offence and the imposition of a qualifying sentence.
