Cupi v Government of Albania

Extradition – Extradition order. The Divisional Court dismissed the appellant's appeal against the judge's decision to send his case to the Secretary of State for a decision whether he should be extradited to Albania to serve a sentence of 25 years' imprisonment for murder, attempted murder and possession of a firearm. The appellant had an effective right of retrial and would not be deprived of that right if the requesting state obtained evidence that he had absented himself from trial, and the evidence had amply enabled the judge to find that there had been insufficient evidence that any blood feud had remained active.
