Article 17 of Council Directive (EEC) 86/653 should be interpreted as meaning that the indemnity and compensation regimes laid down by that article, in the event of termination of the commercial agency contract were applicable where termination occurred during the trial period provided for by the contract. The Court of Justice so held in a preliminary ruling in proceedings concerning payment of, first, compensation for the loss arising from the termination of a commercial agency contract the applicant company had with the respondent company and, second, damages it alleged it was owed as a result of the wrongful termination of that contract.
