Brogden and another v Investec Bank plc

Contract – Breach. The Court of Appeal, Civil Division, dismissed the appellant's claim for breach of contract on the part of their employer, a bank, on the grounds that the bank had failed to pay bonuses to which they claimed to be entitled. On the evidence, the appellants' rights to bonuses had remained as they had been from the inception of their contracts, although the bank had been entitled to make ex gratia payments to increase the size of the bonus pool.
