Company – Director – Disqualification. Court of Session: Refusing an appeal by a director of an insolvent company against a sheriff's decision that he was unfit to be concerned in the management of a company and that he should be disqualified from being a company director for 3 years, the court held that the sheriff was entitled to conclude that the appellant had applied a policy of discrimination amongst the company's creditors at a time when its cash resources were finite with no prospect of any further earnings, and she was entitled to find that he was unfit to be concerned in the management of a company.
