Ball and others v Ball and others

Will – Testator. The claimants' challenge to their mother's will was dismissed by the Chancery Division. The claimants had complained to the police about sexual assaults committed by their father, and the will had excluded them from benefit. The court held that the testatrix had not lacked capacity, and there had been no undue influence upon her. Further, the claimants' claim for reasonable provision under the Inheritance (Provision for Family and Dependents) Act 1975 did not succeed.
