Employment – Equal pay. The Employment Appeal Tribunal (the EAT) dismissed an appeal by the appellant former employer of the first respondents, who had brought equal pay claims against it. The EAT held that the employment tribunal (the tribunal) had been entitled to order disclosure, by a third party, of judgments and interlocutory orders relating to cases brought against the appellant, which were similar to those being litigated by first respondents in the present case. The circumstances, unusually, justified the order for disclosure at an early stage in the proceedings and, in the circumstances, it had been competent and appropriate for the tribunal to order disclosure without first examining the documents.
