Limitation of actions – Triennium. Court of Session: Dismissing an action in which the pursuer sued the defender for professional negligence after undergoing reconstructive surgery following treatment for *** cancer, and in which the pursuer admitted that the action was time-barred but sought to invoke the court's discretion under s 19A of the Prescription and Limitation (Scotland) Act 1973 to allow it to proceed, the court concluded that the pursuer had failed to plead a relevant and sufficient basis for the issue of whether the discretion should be exercised to proceed to proof.
