Ahmed and others v Ingram and another (Joint trustees in bankruptcy of the estate of Ahmed the above-named Debtor)

Bankruptcy – Disposal of property. Section 284 of the Insolvency Act 1986 did not provide a free-standing right to recover the compensation for the void transfer of shares. The Court of Appeal, Civil Division, held that in order to recover equitable compensation, a trustee had to show actual loss caused by the breach, thus equating the equitable principle for calculating compensation, with the common law principle of assessing loss.
