Human rights – Infringement. The Family Court held that breaches of the claimants' rights by the respondent local authority's without notice application for removal of a baby from the care of his parents were sufficiently serious for an award of damages of £3,750 per claimant. Notwithstanding that without a total costs award the damages award would be absorbed by the statutory charge in s 25 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012, the authority was ordered to contribute to the claimants' publicly funded costs for limited periods.
