The claimant did little more than disagree with the value judgment which the judge had been expressly invited to make and had made, and the appeal court should not overturn a trial judge's findings of fact unless compelled to do so. Accordingly, the Court of Appeal, Civil Division, dismissed the claimant's appeal against the judge's decision that two disc brake calipers manufactured by the defendant did not infringe patent GB 2,451,690.
