There had been a serious breach of the duty of candour and co-operation by the Secretary of State, and the evidence supported the claimant's fundamental submission that the 'expedited process' in response to the impending demolition of the makeshift tented encampment in Calais had been unfair and unlawful as a matter of common law. Accordingly, the Court of Appeal, Civil Division, in allowing the claimant's appeal, declared that there had been a breach of the duty of fairness under the common law.
