Extradition – Extradition order. The Supreme Court found held in deciding whether to allow an appeal by the Lord Advocate against a decision of the Scottish Court of Appeal regarding the extradition of the respondent held, amongst other things, that the correct test in demonstrating substantial grounds for believing that a person faced a real risk of being subjected to treatment contrary to art 3 of the European Convention on Human Rights was whether the state had failed to provide reasonable protection against harm inflicted by non-state agents.
