The Court of Appeal, Civil Division, dismissed an appeal by the trustees of a pension scheme and held that the words in the definition of the Retail Price Index (RPI) 'or any replacement adopted by the Trustees without prejudicing Approval' contained in the rules of the pension scheme meant the RPI or any index published by the relevant authority that replaced the RPI and was then adopted by the trustees. Accordingly, it did not the RPI or any index that was adopted by the trustees as a replacement for the RPI, such as the Consumer Prices Index.
