The Queen's Bench Division refused the defendant companies' application to stay claims against them by 218 claimant victims of ethnic violence carried out by armed criminals on their plantation in Kenya after the presidential election in 2007 on the grounds that, in order to decide them the court would have to adjudicate on foreign act of state. However, there was no real issue between the claimants and the first defendant, and the claim against the second defendant had no reasonable prospect of success.
